§1 General Provisions

  1. This document defines the rules for using the online store The Your Aromat, available at www.youraromat.com.
  2. The store is operated by the company The Your Aromat Viacheslav Bezuhlyi, registered in the Central Register and Information on Economic Activity (CEIDG), NIP: 8993042834, REGON: 543358758, with its registered office at ul. Adama Kopycińskiego 5/8B, Wrocław 52-131.

  4. Use of the website implies acceptance of these Terms and Conditions and an obligation to comply with them. The Terms and Conditions do not limit Consumer rights resulting from applicable legal provisions – in case of discrepancies, statutory provisions shall prevail.

§2 Definitions

  1. Consumer – a natural person making a purchase for purposes not directly related to their business or professional activity.
  2. Customer – any natural person, legal person, or organizational unit placing an order in the Store.
  3. Goods – products offered by the Store, in particular samples and perfumes in the form of decants.
  4. Order – the Customer's declaration of intent, constituting an offer to conclude a sales agreement with the Seller.

§3 Placing Orders

  1. Orders can only be placed via the Store's website.
    The Store may refuse to accept orders placed by other means, unless prior consent has been given.
  2. The Customer is obliged to provide true and complete data necessary for the fulfillment of the order, including contact details and delivery address.
  3. After placing an order, the Customer will receive confirmation of its acceptance via email. Upon sending this confirmation, a sales agreement is concluded, in accordance with the selected payment method.
  4. Information placed next to products in the Store, such as price, description, or delivery method, is for informational purposes and constitutes an invitation to conclude an agreement within the meaning of Art. 71 of the Civil Code.
  5. The sales agreement is concluded:
  6. in the case of payment by bank transfer – at the moment the payment is credited to the Seller's account,
  7. in the case of payment by card or via an online payment operator – at the moment of transaction authorization.
  8. Order fulfillment depends on the availability of goods. In the absence of a given product, the Store will inform the Customer, who may:
    8.1. Consent to partial fulfillment,
    8.2. Cancel the order in its entirety,
    8.3. Wait for stock replenishment.
  9. In the event of permanent unavailability of the goods, the Store will refund the funds to the Customer within 7 business days.
  10. The Customer may make changes to the order until the moment of its shipment (including change of address, quantity of products, cancellation of the order) by contacting the Store.
  11. A fiscal receipt or VAT invoice (at the Customer's request) is attached to each shipment.

§4 Order Fulfillment and Delivery

  1. Orders are fulfilled within 3 business days from the moment of receiving payment.
    In case of delay, the Customer will be informed, and the maximum fulfillment period will not exceed 10 business days..
  2. Deliveries are carried out via courier companies or Poczta Polska. The shipping cost is added to the order value.
  3. The Store fulfills orders within Europe and other countries.
  4. After shipment, the Customer receives a number enabling tracking of the shipment through the courier company.
  5. The Customer undertakes to collect the shipment. Upon receipt, it is recommended to check the contents and, if necessary, prepare a damage report in case of damage or shortages.

§5 Payments

The following forms of payment are available in the Store:

  1. Traditional bank transfer
  2. Electronic payments via systems such as Przelewy24/BLIK or Shopify Payments.
  3. Payment must be made within 7 business days from the moment of placing the order. Failure to pay within this period may result in the cancellation of the order.
  4. Proof of purchase (receipt or invoice) is provided in electronic or paper form along with the shipment.

§6 Withdrawal from the Agreement

  1. A Customer who is a Consumer has the right to withdraw from a distance agreement within 14 days from the date of receipt of the goods, without giving any reason.
  2. The declaration of withdrawal can be sent to the e-mail address: theyouraromat@gmail.com
  3. The returned goods should be sent back to the address provided by the Store - ul. Adama Kopycińskiego 5/8B, Wrocław 52-131 within 14 days from submitting the declaration of withdrawal.
  4. Return costs are covered by the Customer.
  5. The Store will refund the funds to the Customer within 14 days, except for delivery costs exceeding the cheapest available option.
  6. According to Art. 38 point 5 of the Consumer Rights Act, the right of withdrawal does not apply to goods opened after delivery, which for hygienic reasons cannot be resold.

§7 Complaints

  1. The Store undertakes to deliver goods free from physical and legal defects.
  2. Complaints should be submitted via email to the address: theyouraromat@gmail.com or by mail to the Seller's registered office address - ul. Adama Kopycińskiego 5/8B, Wrocław 52-131.
  3. The complaint notification should include:
    3.1 Customer data
    3.2 Description of the defect and circumstances of its occurrence
    3.3 Request regarding the method of handling the complaint
  4. The Seller considers the complaint within 14 business days from the date of its receipt.
  5. In case of acceptance of the complaint – the goods will be repaired, replaced, or the Customer will receive a refund.
  6. In the event of a dispute, the Consumer has the right to use out-of-court dispute resolution methods, e.g., through the Consumer Ombudsman.

§8 Protection of Personal Data

  1. Personal data of Customers are processed in accordance with applicable legal provisions, including Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
  2. Detailed information on the rules for processing personal data can be found in the Privacy Policy available on the Store's website.
  3. The Customer has the right to access their data, correct them, delete them, and object to their processing.

§9 Final Provisions

  1. The Store reserves the right to make changes to the Terms and Conditions. Any change will be announced on the website www.youraromat.com
  2. In matters not regulated by these Terms and Conditions, the provisions of the Civil Code and other applicable laws shall apply.
  3. The Terms and Conditions are effective from the date of their publication on the Store's website.

STATEMENTS REGARDING PRODUCT ORIGINALITY AND TRADEMARKS (DISCLAIMER)

  1. The Your Aromat store is not affiliated with, authorized, or endorsed by the manufacturers of the brands whose perfumes are in our offer. All trademarks, trade names, and logos are the property of their respective manufacturers and are used solely for informational purposes and scent identification.

  2. The decants offered by us are 100% original perfumes coming from authentic bulk bottles.

  3. The decanting process is carried out independently by [Your Store Name] under sterile conditions. The finished product is delivered in a neutral, glass atomizer, which is not the official packaging of the manufacturer of the given brand.

  4. By purchasing a decant, the customer is aware that they are receiving a product in replacement packaging, prepared for an individual order, which allows for testing the scent before purchasing a full-size bottle.
